1. Purpose and Scope
This Consultation & Preventive Psychological Support Agreement ("Agreement") governs the provision of preventive psychological support, psychoeducation, self-regulation support, and related Services by Logout Neuchâtel Association ("Logout Neuchâtel" , "the Association" , "we" , "us" , or "our).
The Agreement applies to individual and family Consultations provided in person, remotely, or through other agreed delivery formats.
The purpose of the Consultation is to support individuals and families in understanding and managing psychological, behavioural, relational, and cognitive challenges associated with digital technologies and their use.
The Service is preventive in nature and is intended to support healthier functioning before difficulties require specialized clinical or psychiatric treatment.
2. Nature of the Service
Logout Neuchâtel provides Services focused on:
- psychoeducation;
- prevention;
- self-regulation;
- behavioural reflection;
- digital well-being;
- healthy technology-use habits;
- attention and cognitive-load management;
- relational boundaries concerning technology;
- family communication concerning digital use;
- understanding technology-related stress; and
- development of practical strategies for healthier technology use.
The Consultation may include discussion, structured reflection, educational information, behavioural strategies, exercises, and recommendations concerning digital habits.
The precise content of a Consultation depends on the individual's or family's circumstances.
3. Preventive and Non-Emergency Nature
The Consultation is a preventive psychological support service.
It is not intended to replace medical, psychiatric, emergency, or specialized clinical care.
Logout Neuchâtel does not provide, through this Service:
- psychiatric diagnosis;
- medical diagnosis;
- prescription of medication;
- psychopharmacological treatment;
- emergency psychiatric intervention;
- emergency medical treatment;
- medical certificates; or
- treatment requiring a level of clinical or medical care outside the scope of the Service.
Where an individual's needs exceed the scope of preventive support, Logout Neuchâtel may recommend or facilitate referral to an appropriately qualified healthcare professional or other specialist.
4. No Guarantee of a Particular Outcome
Participation in a Consultation does not guarantee a particular psychological, behavioural, relational, academic, professional, or health outcome.
The effectiveness of preventive support depends on multiple factors, including:
- individual circumstances;
- motivation;
- environment;
- relationships;
- technology use;
- implementation of recommendations; and
- factors outside the control of Logout Neuchâtel.
The purpose of the Service is to provide professional support and evidence-informed guidance, not to guarantee a specific result.
5. Consultation Formats
Depending on availability and the Service purchased, Consultations may be provided:
5.1 Individual Consultation
A focused session concerning the participant's individual circumstances and digital habits.
The standard duration is 40 minutes, unless otherwise specified at the time of booking.
5.2 Family Consultation
A Consultation involving members of the same household or family.
Family Consultations may address:
- communication;
- household technology rules;
- parental guidance;
- screen-use boundaries;
- conflict concerning digital technology; and
- shared strategies for healthier technology use.
The participants and duration of a Family Consultation will be specified at the time of booking.
5.3 Online Consultation
Consultations may be provided remotely through an appropriate communication or video-conferencing platform.
Participants are responsible for ensuring that they have:
- a suitable device;
- an adequate internet connection;
- a reasonably private environment; and
- an appropriate setting for confidential communication.
5.4 In-Person Consultation
Where available, Consultations may be provided at an agreed location.
5.5 Home Visits
Home visits may be available within the applicable geographic area and subject to prior agreement, availability, and any additional applicable fee.
6. Booking and Confirmation
A Consultation may be requested through the booking mechanism provided by Logout Neuchâtel.
A booking is confirmed when Logout Neuchâtel or its designated booking system confirms the appointment.
The booking confirmation may specify:
- date;
- time;
- location or online access method;
- duration;
- applicable fee;
- cancellation conditions; and
- other relevant information.
You are responsible for providing accurate contact and booking information.
7. Fees and Payment
Consultations are paid directly by the individual, family, or Organization responsible for the booking unless otherwise agreed.
Applicable prices are communicated at the time of booking or through the relevant Service page.
Membership discounts apply only where the applicable membership is valid and the relevant Service is eligible for the discount.
Unless expressly stated otherwise, Consultation fees are not included in the annual membership fee.
8. Insurance and Reimbursement
Logout Neuchâtel Services are currently not represented as being covered by Swiss compulsory health insurance (LAMal/KVG).
You are responsible for verifying with your insurer whether any reimbursement or contribution may be available under your individual insurance arrangements.
Logout Neuchâtel does not guarantee reimbursement by any insurer.
9. Cancellation and Rescheduling
You may request cancellation or rescheduling of a Consultation through the contact or booking mechanism specified at the time of booking.
The applicable cancellation period and any cancellation fee will be communicated at the time of booking.
Where no specific cancellation period has been communicated, Logout Neuchâtel may apply the cancellation rules published for the relevant Service.
Where reasonably possible, we will seek to accommodate legitimate requests to reschedule.
10. Non-Attendance and Late Arrival
If you do not attend a scheduled Consultation without prior notice, the session may be treated as a missed appointment.
If you arrive late, the Consultation may nevertheless end at the originally scheduled time.
This is intended to respect subsequent appointments and the agreed schedule.
Any applicable fee for a missed or late-cancelled appointment will be determined in accordance with the cancellation conditions communicated at booking.
11. Confidentiality
Information disclosed during a private Consultation will be treated confidentially, subject to applicable law and the professional obligations applicable to the person providing the Service.
Logout Neuchâtel will not ordinarily disclose information from an individual Consultation to:
- employers;
- schools;
- universities;
- insurers;
- family members;
- other participants; or
- other third parties without an appropriate legal basis or consent where consent is required.
Confidentiality is not absolute and may be subject to legal exceptions.
12. Limits to Confidentiality
Information may be disclosed where:
- disclosure is required by law;
- disclosure is required by a competent authority;
- disclosure is necessary to comply with a legal obligation;
- disclosure is necessary to protect a person from a serious and legally relevant risk, where permitted or required by law;
- disclosure is necessary to establish, exercise, or defend legal claims; or
- another lawful basis for disclosure applies.
The applicable confidentiality framework may depend on the qualifications and professional status of the individual providing the Consultation.
13. Family Consultations and Confidentiality
Where multiple members of a family participate in a Consultation, each participant remains an individual participant in relation to confidential information.
Information disclosed privately by one participant will not automatically be disclosed to another participant.
Participants should understand that confidentiality within a joint Family Consultation cannot be guaranteed in the same manner as a private individual Consultation because multiple participants are present.
Before disclosing information between participants, Logout Neuchâtel may seek appropriate consent or determine that disclosure is otherwise legally justified.
14. Consultations Involving Minors
Certain Logout Neuchâtel Services may be provided to children or adolescents.
Where a minor participates in a Consultation, the Association will take into account:
- applicable parental-authority rules;
- the minor's age and maturity;
- safeguarding considerations;
- applicable confidentiality obligations;
- the nature of the Service; and
- applicable Swiss law.
Where parental or guardian authorization is legally required, it must be obtained before the Service is provided.
The existence of parental authority does not necessarily mean that every communication made by a minor during a Consultation will automatically be disclosed to a parent or guardian.
Where appropriate, the limits of confidentiality will be explained to the minor and the parent or guardian before or during the Service.
15. Emergency Situations
Logout Neuchâtel is not an emergency service.
A Consultation must not be used as the sole source of support where an individual:
- is in immediate danger;
- presents an imminent risk of serious harm to themselves or another person;
- requires emergency medical attention;
- requires emergency psychiatric intervention; or
- is experiencing a crisis that exceeds the preventive scope of the Service.
In such circumstances, the participant should seek immediate assistance from an appropriate Swiss emergency or healthcare service.
Where Logout Neuchâtel becomes aware of a serious and immediate safety concern, it may take reasonable action consistent with applicable law, confidentiality obligations, safeguarding requirements, and the circumstances known at the time.
16. Referral to Other Professionals
Logout Neuchâtel may recommend referral to another professional where an individual's needs fall outside the scope of preventive support.
Referral may include recommendation to:
- a psychologist;
- psychotherapist;
- psychiatrist;
- physician;
- specialized healthcare provider;
- social service;
- educational professional; or
- another appropriate professional or institution.
A referral does not constitute a diagnosis.
The participant remains responsible for deciding whether and when to seek additional professional assistance, except where mandatory legal obligations apply.
17. Participant Responsibilities
Participants are expected to:
- provide reasonably accurate information;
- communicate relevant changes in circumstances;
- attend appointments on time;
- treat staff and other participants respectfully;
- maintain confidentiality concerning other participants;
- use online systems responsibly;
- provide a suitable environment for remote Consultations; and
- follow reasonable safety instructions.
Participants should inform Logout Neuchâtel if they believe that the Service is no longer appropriate for their circumstances.
18. Online Consultation Requirements
For online Consultations, participants should take reasonable measures to preserve confidentiality.
Where possible, participants should:
- use a private room;
- use headphones where appropriate;
- avoid public Wi-Fi where reasonably practicable;
- protect access to their device;
- avoid allowing unauthorized persons to hear the Consultation; and
- avoid recording the Consultation without prior authorization.
Logout Neuchâtel is not responsible for confidentiality breaches caused by the participant's own environment, device, account, or network where such circumstances are outside our reasonable control.
19. Recording
Consultations are not ordinarily recorded by Logout Neuchâtel.
Participants must not record, photograph, screenshot, or otherwise reproduce a private Consultation without the prior consent of the relevant participants and Logout Neuchâtel, where applicable.
If recording is required for a specific programme, research activity, training activity, or other legitimate purpose, participants will be informed separately and any required consent will be obtained.
20. Personal Data
Personal Data processed in connection with a Consultation is governed by the Logout Neuchâtel Privacy Policy.
Depending on the nature of the Consultation, information may include sensitive Personal Data.
We seek to limit collection and processing to information reasonably necessary for the relevant Service.
Further information concerning:
- data collection;
- confidentiality;
- data storage;
- retention;
- third-party providers;
- international transfers;
- data-subject rights; and
- security is provided in the Privacy Policy.
21. Notes and Documentation
Where appropriate, Logout Neuchâtel or the professional providing the Service may create limited records necessary to:
- administer the Consultation;
- maintain continuity of support;
- document relevant administrative information;
- comply with legal obligations;
- protect the participant or another person; or
- establish, exercise, or defend legal claims.
The nature and extent of documentation will depend on the Service and applicable legal and professional requirements.
Participants may exercise applicable data protection rights in accordance with the Privacy Policy and applicable law.
22. Third-Party Platforms
Online Consultations, booking, payment, or other aspects of the Service may rely on third-party technology providers.
These providers may process technical or transactional information in accordance with applicable arrangements and their own privacy policies.
Logout Neuchâtel does not control the independent processing carried out by third-party providers.
23. AI and Digital Tools
Some Consultations or associated educational activities may involve discussion of:
- artificial intelligence;
- AI companions;
- chatbots;
- algorithmic systems;
- social media;
- digital platforms; or
- other technologies.
Where digital or AI-enabled tools are used as part of a Service, they are intended to support education, reflection, or prevention.
AI-generated information must not be treated as a diagnosis or as a substitute for qualified professional judgment.
Participants should not enter confidential Consultation information into external AI systems unless expressly authorized and appropriately protected.
24. Professional Boundaries
Logout Neuchâtel seeks to maintain appropriate professional boundaries in all Consultations.
Unless expressly agreed as part of the Service, participants should not expect continuous or emergency availability outside scheduled sessions.
Messages received outside scheduled service periods may be answered during normal operating periods.
The Consultation does not create an obligation for continuous monitoring of a participant's condition.
25. No Emergency Monitoring
Email, contact forms, booking systems, messaging platforms, and other digital communication channels are not continuously monitored for emergencies.
Sending information through these channels does not create an expectation of immediate intervention.
Participants experiencing an emergency should use appropriate emergency or healthcare resources rather than relying on Logout Neuchâtel's ordinary communication channels.
26. Termination of the Consultation Relationship
Either the participant or Logout Neuchâtel may discontinue future Consultations, subject to:
- applicable contractual obligations;
- outstanding payment obligations;
- scheduled appointments;
- cancellation conditions; and
- applicable professional or legal requirements.
Logout Neuchâtel may discontinue a Consultation relationship where:
- the Service is no longer appropriate;
- the participant's needs exceed the scope of the Service;
- continued provision would create a significant safety concern;
- serious misconduct occurs;
- the participant repeatedly violates applicable rules;
- payment obligations remain outstanding; or
- another legitimate and legally permissible reason exists.
Where appropriate, we may recommend referral to another professional.
27. Liability
Logout Neuchâtel provides preventive psychological support and psychoeducation but does not guarantee a particular outcome.
To the maximum extent permitted by applicable Swiss law, the liability provisions contained in the Terms of Service apply to the Consultation.
Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited.
28. Applicable Law
This Agreement is governed by Swiss law, subject to mandatory provisions applicable to the participant.
Any dispute shall be handled in accordance with the dispute-resolution and jurisdiction provisions contained in the Terms of Service, subject to mandatory applicable law.
29. Relationship with Other Documents
This Agreement should be read together with:
- the Terms of Service;
- the Privacy Policy;
- the Cookie Policy, where applicable;
- applicable Membership Terms; and
- any specific terms communicated at the time of booking.
If a specific written agreement governing a particular Consultation conflicts with this Agreement, the specific agreement shall prevail with respect to that Consultation.
30. Acknowledgement
By booking or participating in a Consultation, the participant acknowledges that they have had a reasonable opportunity to review this Agreement and understand that:
- the Service is preventive in nature;
- it is not a substitute for medical, psychiatric, emergency, or specialized clinical care;
- no specific outcome is guaranteed;
- confidentiality has legal and professional limits;
- the Service is not an emergency response service; and
- the processing of Personal Data is governed by the Privacy Policy.
